In a few New York City restaurants, such as Sushi Uo, the legs of octopuses are sheared off bit by bit and then served and consumed while the animals are still squirming. Other octopuses are slowly steamed alive in front of customers before the animals’ tentacles and upper bodies are cut into small pieces with scissors.

We need your help in educating consumers and asking both the Queens County District Attorney’s Office and the New York County District Attorney’s Office to file charges of cruelty to animals against anyone who prepares and serves live animals. Join us in holding posters and passing out leaflets to let people know that chopping up and serving live animals is not acceptable!

Posters and leaflets will be provided, so just bring yourself and anyone you can recruit to join you. For more information or to RSVP, please contact me at HeatherN@peta.org. When replying, please mention the date and location of the demonstration that you plan to attend.

CONGRATULATIONS to the ASPCA and Council Speaker Christine Quinn for winning certain points in easing conditions for the Central Park carriage horses. I work for animals. I fight for animals. I’m on the board of the ASPCA. I treasure this organization because I know they’ve been in the forefront of this — and many other — fights forever.

Recently, when this first bit of easing for these horses finally came through, I would just like them to have remembered to mention my part in it.

Years ago, their president couldn’t get himself arrested on this issue. Couldn’t get a meeting with New York City Council Speaker Christine Quinn. Couldn’t nail a meeting with one of her aides. Wasn’t even getting phone calls returned from her office because the problem of tourism and NYC and the excitement of the Central Park carriage horses had put the speaker squarely on the other side.

I know Christine. We have dinner together. I’m a friend of Christine’s. I know her to be, in my view, fair and just. And very smart. I asked her to do me a personal favor. She agreed. We picked a day, and I met her on that one specific afternoon and brought her up to the ASPCA boardroom to talk to us. To hear our views firsthand. We understood hers. We only wanted her to hear ours. It was a closed meeting. A couple of hours. Just a handful of us from the ASPCA board, Christine and her two aides.

This is not to discuss the issues here nor to list the various celebrities and politicians lined up on either side. This is just to say this month the ASPCA was grateful that New York’s City Council passed regulations requiring carriage horses to have larger stalls, five weeks off per year and blankets in cold and wet weather.

The New York City Council did that. Its Speaker is Christine Quinn.

Christine Quinn has lied the public once again, and she’s even managed to fool Cindy Adams. 

On the surface, the improvements listed in the horse-drawn carriage bill sound great to an unsuspecting public. The carriages can no longer work below 34th street and can no longer work from 3:00 a.m. - 7:00 a.m. But they never did work below 34th, and they don’t give carriage rides now between 3-7 a.m. So how are these new regulations helping the horses? 

Quinn also states that the horses will get a 5 week vacation. As Quinn knows, horses don’t need a five week vacation; they need daily turn out in a pasture where they can graze, run, roll and interact with other horses, as herd animals do. In NYC, the horses have no pasture. In fact, they’re denied the chance to do anything that comes naturally to them. They’re either stored in a small stall in a multi-story warehouse, or they’re confined between the shafts of a carriage. 

Over the past four years, many veterinarians and animal welfare organizations have met with Quinn to convey the many reasons why horse-drawn carriages cannot be operated humanely or safely in the streets of NYC. In response, she has passed a bill that does nothing more than give carriage drivers a rate hike while fooling the public into thinking she’s improved the lives of the horses.

Ms. Adams is misinformed on the horse carriage issue. The bill that passed benefited the drivers and carriage owners. The bills that would have benefited the horses were not even voted on (Intro 86 and Intro 92.) For being on the board of the ASPCA, Ms. Adams should be aware that the ASPCA was OPPOSED to the carriage horse bill (Intro 35A) that their representatives lobbied AGAINST this bill, and that Speaker Quinn had this legislation pushed through this Council. Speaker Quinn has one of the worst ratings on animal related issues of any council member, according to stats compiled by the NY League of Humane Voters. Finally, Speaker Quinn is one of the biggest obstacles to humane animal legislation in New York City. I don’t have dinner with Speaker Quinn, as Ms. Adams does. I am not her friend. I am an informed animal advocate. On this issue, Ms. Adams appears to wearing the blinders, not the horses.

A letter from Donny Moss, producer of “Blinders”

Dear friends:


On April 14th, NYC Council Speaker Christine Quinn pushed a bill through the City Council that protects and rewards the horse-drawn carriage industry by giving the drivers a rate hike.   To give Quinn political cover, the bill includes language that gives the false impression that the horses will be treated more humanely, when, for all intents and purposes, nothing will change for the horses.   They still will still be deprived of a pasture for grazing and interacting; they will still live in multi-story warehouse buildings that are fire traps; and they will still be subjected to the many cruel and dangerous conditions in NYC that can’t be fixed.

In the attached NY Times story, Quinn describes the bill as “a huge step forward,” but for those of us who have spent many years trying to end the cruelty, this bill is huge step backwards.      What is particularly disturbing about this setback is that it comes on the heels of four years of heavy campaigning by local and national organizations, including the ASPCA, the Coalition to Ban Horse-Drawn Carriages,  Friends of Animals, the League of Humane Voters, PETA, the Humane Society of the United States, Win Animal Rights and NY-CLASS.   The campaigns have included lobbying, producing educational materials and videos, running ad campaigns, conducting street demonstrations and submitting petitions signed by thousands of NYers.  This work, which has educated the public about the issue, made no difference at all to Quinn.  Nor did the thousands of letters she received asking her to show some compassion.  She did what, for complicated reasons, is politically expedient for her:  protecting the industry.


We shouldn’t be surprised that Quinn pushed through a rate hike and blocked the bills that would end the abuse because, since becoming Speaker, she has blocked every single bill introduced at City Hall to protect animals, including the bill that requires pet stores to install sprinklers so that no more dogs and cats burn to death in their cages, a tragedy that has occurred too many times in NYC.  As long as Quinn is in office, NYC’s animals don’t stand a chance.

Thanks to NYC taxpayers, Quinn has a staff of people (the “Community Affairs Unit”) already working hard to ensure that she is elected Mayor in 2013.   The burden is on each of us to ensure that NYers know the truth about Quinn and that she is voted out of public office for good (We came close in 2009!)

I am writing to ask that you do what is in your power to see that a permit is NOT issued to the Cole Bros. Circus for their planned performances in Midland Beach this summer. As the circus performances have taken place in your district in the past, I thought you would be an appropriate contact for this request.

The Cole Bros. Circus has a long history of animal welfare violations issued by the U.S.D.A. As you know, Councilman Vincent Ignizio (R- 51st), is a co-sponsor of NYC Council Bill INTRO 389, which would ban wild animal performances in New York City.

I am writing to ask that you do what is in your power to see that a permit is NOT issued to the Cole Bros. Circus for their planned performances in Queens this summer. As the permit would involve NYC Parks and Recreation property, I thought this would best be handled by you.

The Cole Bros. Circus has a long history of animal welfare violations issued by the U.S.D.A. (See attached documents.)

In addition, there are some serious public safety concerns related to the Cole Bros. Circus. A man who played a the star clown with the Cole Bros. Circus was arraigned in NY on a 15-count indictment which included four counts of sodomy, four counts of sexual abuse in the first degree, and three counts of endangering the welfare of a child (Associated Press).

According to the AP, the clown, known as “Smiley the Clown”, was found guilty on nine counts, including sodomy, sexual abuse, and endangering the welfare of a child.

Several years ago, a 450 pound white tiger escaped from Cole Bros. during a cage transfer near the Forest Park bandshell in Queens. Dozens of police officers with machine guns and tranquilizer darts pursued the tiger for half an hour as he prowled for a mile through the crowded park, scattering screaming people and causing two traffic accidents. Two women filed a $60 million lawsuit after suffering spinal fractures and other injuries in the multicar pileup on the Jackie Robinson Parkway.

Mr. Oddo, in the interest of the public’s safety, and with Cole Bros. abysmal record of repeated animal abuse and neglect, I ask that you deny any such permit or application for performances by Cole Bros. Circus on Staten Island this year, and in the future. I hope you can appreciate the merits of my request.

The man who plays Smiley the Clown was arraigned Thursday in New York on a 15-count indictment which included four counts of sodomy, the Suffolk County District Attorney’s Office said.

Christopher Bayer, known as Smiley the Clown at the DeLand-based Clyde Beatty-Cole Bros. Circus, was arrested Saturday on Long Island on charges he was “engaging in sex acts” with a 16-year-old boy who had been a longtime friend.

The indictment also charges Bayer with four counts of sexual abuse in the first degree and three counts of endangering the welfare of a child

A Tiger Hangs Out In Queens

NYers have a rep (well-deserved in most cases) for being blase and nonchalant about bizarre occurences that happen in city life (except for seeing naked people in the apartment across the way - that’s always cause for a phone call to a friend) because that just the way it is. Except when it comes to tigers roaming city streets. That’s why an escaped tiger escaped tiger stopped traffic in Queens. The 450 pound white tiger, Apollo, some how got loose from the Cole Bros. Circus in Forest Park, Queens, and wandered around. The NY Times detailed his journey:

The cat took the Myrtle Avenue entrance ramp to the Jackie Robinson, where he loped along before cutting through some woods and followed a path up to a hole in a chain-link fence on 88th Lane near Myrtle Avenue.

Not that Gothamist would have wanted a terrible accident or someone to have gotten hurt, but it would have been pretty amazing if this happened during the morning commute and the traffic reporters had to report that. Apollo’s trainers helped subdue him and the NYPD and Parks department helped get him into a cage by cordoning off the road. One onlooker told the Post, “He was just lying in the bushes. He looked exhausted.” Yes, NYC traffic can do that to a soul. The Cole Bros. Circus was slapped with a health code summons (that’s it?) and tigers weren’t part of yesterday’s Cole Bros. Circus performance, as the circus tries to figure out how Apollo escaped. One 6 year-old circus goer told the Daily News, “It’s corny if they have no tigers.” Word. Of course, this incident is giving NY State Senator Carl Kruger even more reason to ban the Cole Bros. Circus, what compounded with the flying cat “cruelty” finding earlier.

Gothamist imagines that Apollo was trying to get the Bohemian Beer Garden in Astoria, or perhaps the new Lee Bontecou exhibit at the MoMA Queens. We wonder what would have happened if Ming the tiger had escaped his Harlem apartment - a trip to Sylvia’s, perhaps?

Escaped Circus Tiger Lawsuit Settlement

Finally, we all have closure for a 2004 incident where a tiger from the Cole Bros. Circus escaped, ran along the Jackie Robinson Highway, and then passed out in some bushes. See, drivers who caught glimpse of Apollo, a 450-pound tiger, were naturally startled and ended up in a five-car pile-up (started when one driver didn’t want to hit the huge creature). And, naturally, those drivers sued. 1010WINS reports that the tiger’s trainer will pay a near $1 million settlement to two drivers “both claimed to have suffered devastating back injuries in the chain-reaction car crash.” Apollo’s escape at the time gave State Senator Carl Kruger more reason to ban the circus, especially considering Cole Bros. had also included flying cats.

STATEN ISLAND, NY – NEW DORP — Dr. John G. Hynes often has a few furs in the trunk of his car.

“I often wonder what will happen if I get pulled over,” he said.

Not that there is anything illegal going on, but it does look a bit odd.

Dr. Hynes, a veterinarian with practices in New Dorp and Annadale, participates in a program called Coats for Cubs. He collects furs that people donate and sends them to the Humane Society of the United States. The furs are distributed to wildlife rehabilitators who use them as security blankets for injured and orphaned animals such as raccoons and foxes.

This commitment may seem a natural extension of his profession, but when he ran for office recently in the American Veterinary Medical Association (AVMA), it was to make more humane treatment of animals a central role of a profession dedicated to caring for them.

Dr. Hynes grew up in a house without pets, but when his first- grade class read a book about a veterinarian, he was touched and stuck with his 7-year-old epiphany.

The Monsignor Farrell High School graduate earned a bachelor of science degree from Cornell University and a doctor of veterinary medicine degree from Mississippi State University.

After 16 years of practice, a pivotal moment transformed his role as a veterinarian. A documentary on television about animals being beaten and skinned alive for their pelts in China moved him to become active in bringing attention to the cruel treatment of animals which is most often justified when a profit is to be made.

“I thought, ‘How can I bring attention to this issue?’ “ said Dr. Hynes, sitting in a small conference room at South Shore Animal Hospital in New Dorp. He also practices in Annadale at the Clinic for Country Estates in and the Greenwich Village Animal Hospital.

His first campaign was to organize a protest at Burberry’s in the Short Hills Mall where the goal was to distribute pamphlets to shoppers in a campaign to convince Burberry to stop using fur in its designs.

A member of People for the Ethical Treatment of Animals (PETA) and the Humane Society of the U.S., he has actively supported Intro 389, a 3-year-old bill in the City Council, that would prohibit wild animal performances, such as in circuses, in New York City. Council member Vincent Ignizio (R-South Shore) is a co-sponsor of the bill.

Dr. Hynes has provided borough parks commissioners, borough presidents and city council members with detailed information about the treatment of elephants in particular. He has been unsuccessful, to date, in getting a response from Borough President James Molinaro and City Councilman James Oddo (R-Staten Island/Brooklyn) about the Cole Brothers Circus, which rolls out each summer on Staten Island.

However, a chance meeting with Christine Quinn when she was campaigning in November and Dr. Hynes was coming home from a rally with an anti-Quinn T-shirt on (because of her lack of support for the bill) led to a sit-down with Ms. Quinn and members of PETA, the New York League of Humane Voters, and Rosie Mendez of Queens, the author of Intro 389.

RaeLeann Smith, Circus and Government affairs specialist with PETA, presented information on the abuse of circus animals as if she was arguing a case, said Dr. Hynes. It is the kind of authority he would like to see his “noble profession” lend to the issues of animal welfare.

His decision to run for the board of the AMVA was galvanized when the organization took no stand on California Proposition 2 that would provide a modicum of comfort to farm animals by requiring they be provided with enough room to be able to lie down, stand up and turn around.

“I considered dropping my membership. It’s not an organization representing how I felt or what I believed,” he said.

Instead, he collected enough signatures to enable him to run as a District 1 representative which covers New York, New Jersey and the New England states – seven states and about 8,000 veterinarians.

Contested elections, while not unheard of, are rare in many professional organizations. Dr. Hynes said his opponent, who had been moving through the ranks of the AVMA, attempted to cast him as a “disruptive force,” pointing out his membership in PETA and the Humane Society.

Dr. Hynes’ advocacy was no secret. He made it clear that the AVMA’s lack of dedication to the issues that these organizations addressed was exactly why he was running.

In a statement publicizing his candidacy he said, “The AVMA refuses to take any significant positions or stand on the most important animal welfare issues, and instead, panders to the pharmaceutical industry, agribusiness, as well as the conservative network of veterinarians who look at animals as commodities and the source of their income.”

Dr. Hynes lost the election, but is satisfied with having “ruffled feathers.” He was told that more ballots were cast in the election than in any in quite a few years.

“As far as was it worth it to run? Definitely. I was able to raise awareness of welfare issues that have been ignored for too long by the profession,” said Hynes. He said he will maintain his membership to continue to influence the direction of the organization from within.

PETITION PRESENTED TO NYC COUNCIL TO PROTECT CIRCUS ANIMALS AND WILD ANIMALS USED FOR ENTERTAINMENT

I presented the following petition to the NYC Council Speaker, Christine Quinn, and members of the NYC Council, asking for the passage of Intro 389, (now known as Intro 49 ).  Over 800 individuals signed, and many left personal comments.

We the undersigned, are asking for a hearing, and the passage of Intro 389, (now Intro 49)  which would ban

the use of exotic and wild animals in performances in New York City.   The abuse of elephants

and other wild animals in circuses is as old as the circus itself.  We usually see circus elephants

performing ridiculous tricks and taking commands, restrained in shackles and prodded on and

off trains or trailers. These animals are denied almost everything that is important to them,

including social relationships, mental stimulation, exercise, and emotional outlets.   Their

existence is limited to beatings and confinement in chains and transportation in boxcars and

trailers.

A large percentage of the population is unaware of the abuse that goes on under the Big Top.

Education is the key to making significant change for these animals and ending their lives of

suffering.  Many educated and informed people know that abuse in the name of entertainment is

not acceptable.  Animal free performances, like Cirque du Soleil, provide just as enjoyable, if

not more exciting, experiences as the %u201Ctraditional%u201D animal circuses.   Tradition

should not be an excuse for continuing inhumane or abusive treatment.  Bullfighting and

cockfighting may be considered tradition in some cultures, but that doesn%u2019t mean that

these practices  are not inhumane, or cause undo suffering.

In New York City, there is a bill before the City Council called INTRO 389.  (www.intro389.org),

which would  ban wild animal performances, including animal circuses,  within the city limits

Several animal protection groups, including The Fund for Animals, an affiliate organization of

the Humane Society of the United States, brought charges against Ringling Bros. and Barnum &

Bailey Circus for multiple violations of the Endangered Species Act for abuse of the Asian

elephants in their care.   Undercover videos and photos continue to come out, showing cruel

and inhumane treatment of elephants and other exotic animals, in the control of Ringling and

other animal circuses.

Please support this humane and just bill, and vote to pass Intro 389.

here in Melbourne, Australia. It was Ashtons or Silvers but

cannot remember which one. We were looking at the

animals and walked around the corner on him. He picked

them up out of an opening from the top of their cage and

was cracking them on the head with a metal chain. They

were mere babies. There were about 5 cubs, all with deep

lacerations on their heads. We were just kids when we saw

that and I did hear that 3 or 4 of the 5 cubs were taken

away and had to be destroyed because of this horrible

mans actions, and you wouldn’t believe, than man hitting

them was dressed in a clown suit. I have seen the abuse

first hand…HOW DARE THEY DO THIS TO ANIMALS?

Living conditions of circus animals are inhumane. The

animals live in cramped spaces — tigers and lions live and

travel in cages measuring just 4 by 6 by 5 feet. Elephants

are chained by their legs during training, transport, and

between shows.

The circus is not educational. It portrays wild animals as

approachable and playful – teaching nothing about the

animals, their natural habitats, lifestyles or behaviors.

Many circuses entertain audiences without using animals.

And it’s these circuses that we should welcome to our

town. Using animals as a form of entertainment, especially

when it involves such cruelty, is barbaric.

Bros Circus with my small child, and seeing the absolutely

hopeless/miserable and dead expression in the eyes of the

mammoth elephant walking near to us, I felt a real sense of

unease for our own safety on the entire ride. The elephant

just looked completely miserable and hopeless. It gave me

no joy to see that and I have not returned to a circus since

then. Nor will I ever revisit another circus that uses these

incredible creatures in such a mean and cruel way. The

training techniques are inhumane, and in this day and age,

there is no need for it. A circus has many other attractions

and they need not rely on continuing to incorporate an

animal in its acts when it is abused to make it comply with

the trainers wishes.
